Elon Musk, the CEO of Tesla and SpaceX, faces a high-stakes legal clash in Pennsylvania over his $1 million prize campaign aimed at swing-state voters. What started as a voter engagement initiative has landed Musk and his political action committee, America PAC, in hot water, with accusations that the campaign is nothing more than an illegal lottery.
America PAC recently launched a daily $1 million giveaway for registered voters in key battleground states, including Pennsylvania, to energize civic participation. The controversial giveaway, announced in October, promises daily $1 million prizes for registered voters in swing states—Pennsylvania, Georgia, Nevada, Arizona, Wisconsin, Michigan, and North Carolina—until November 5.
To enter, voters provide personal information and sign a pledge supporting the U.S. Constitution. Musk, who recently endorsed former President Donald Trump, insists the giveaway is not tied to any specific candidate.
Philadelphia’s District Attorney, Larry Krasner, views it differently. Krasner’s lawsuit argues that the prize campaign amounts to a lottery intended to sway voters and accuses Musk’s PAC of violating consumer protection laws by failing to outline clear rules and privacy protections for participants’ data. Additionally, since filing the case, Krasner reports he has received an influx of social media backlash, some of which has been anti-Semitic, intensifying the controversy.

Pennsylvania is often seen as a deciding factor in presidential elections as a critical swing state. With Trump and Vice President Kamala Harris campaigning heavily there, initiatives like Musk’s voter prize draw scrutiny. Krasner’s office argues that any influence on voter behavior could have significant impacts, making Pennsylvania a central stage for this legal showdown.

Musk’s defense is that the prize giveaway is a sweepstakes, not a lottery, claiming it promotes constitutional values without directly influencing voting. The outcome now hinges on a court hearing scheduled for Friday, just days before election day. Judge Angelo Foglietta has ordered Musk and America PAC representatives to present their case in court.
